General Terms and Conditions for purchases made on the website www.idressitalian.com
Idressitalian Srl, with registered office in Via San Marco, n. 21, 20121, Milan, Italy, VAT No. 10019240958 ("IdressItalian") hereby invites users to read these General Terms and Conditions of Sale ("T&C") that govern the purchase of products and the management of orders placed on this website.
The offers on our website www.idressitalian.com (the “Website”) are directed exclusively at consumers who conclude the purchase for a purpose that cannot be attributed to their commercial or professional activity.
IdressiItalian may market its products or allow third-party vendors to offer their products for sale on the Site. The detail pages for each product indicate whether the product is sold by a third party. In such cases, Idressitalian will only facilitates the transactions on the Site, but it will not be party of the contract. Therefore, this contract will be in force only between the client and the third-party seller. In fact, in these cases Idressitalian will not be liable with respect to the contract of sale and its performance and will not act in any way as a seller's agent. The third-party seller will be the solely responsible for selling the products and handling claim and disputes with the client.
1. Contract execution
1.1 By placing an order you confirm to purchase exclusively for private purposes.
1.2 By clicking on "Buy now", you are placing a binding order for the products added in the virtual shopping cart. Once you have submitted your order, within an hour we will send you an e-mail confirmation of your order. A binding contract is formed when you receive the order confirmation from us. If the customer does not receive any confirmation of the order within the term indicated in this art. 1.2., the relevant order shall be rejected by IdressItalian and, therefore, it will have no effect. Please note that the orders will be shipped as soon as we receive payment of the full purchase price and any shipping costs.
1.3 Idressitalian will not be liable in case of products unavailability due to reasons independent from its control, and we will promptly notify you of the products unavailability without undue delay. In any case, If a product ordered is unavailable, we will refund any payments made by you without undue delay.
1.4 We do not assume the obligation to procure ordered products elsewhere. This applies also to orders for generic goods (where only the type and features of the goods are described). We are obliged only to make deliveries from our available stock and from the stock we have ordered from our suppliers. IdressItalian is only obligated to deliver what is available at the warehouses of its partners from which the products ordered by the customer originate. Where time periods are expressed in working days, we mean the days between Monday and Friday inclusive, but not public holidays.
1.5 We reserve the right not to accept an order or to cancel the order if the order is being placed by the use of software, robot, crawler, spider or any automated system or scripted behavior and any use of third-party services used to place an order on your behalf.
2. Prices and shipping costs
2.1 The customer is obliged to pay the price published on the product page when placing the order. The stated price is final and all-inclusive.
2.2 Shipping costs will be borne by the customer. The shipping cost total amount may change depending on the mode of delivery and especially based on the place of delivery. The shipping cost will therefore be indicated in the shopping cart and purchase summary, before the order transmission
3. Payment
3.1 We generally accept the following payment methods: cash in advance, credit card, payment on account and payment through Paypal. We reserve the right not to accept certain payment methods for a given order and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). You are responsible for any costs associated with money transactions.
3.2 You consent to receiving invoices and credits solely in electronic form.
4. Withdrawal Right
The customer has the right to withdraw from any order. However, the withdrawal right is not applicable with respect to products that are not suitable for return for hygienic or health protection-related reasons and that have been opened after delivery, such as, but not limited to, cosmetic products for body care and beauty, beverages, food and the like.
If the customer decides to return the purchased products, he/she may use the return label received with the order. If the customer needs a new return label, he/she may contact customer Service (see contact details given at the end of the page). Please, always use the return label provided by IdressItalian for return to avoid unnecessary additional charges.
4.1 Information about the exercise of the withdrawal right (under art. 49, paragraph 1, letter (h) of the Consumer Code)
The customer has the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract for multiple goods ordered by the customer in a single order and delivered separately, the 14-day period runs from the day on which the customer or a third party, other than the carrier designated by the customer, acquires physical possession of the last good.

For this purpose, it is possible, but not mandatory, to use the standard withdrawal form that can be downloaded here www.idressitalian.com/contacts If the customer decides not to use the standard withdrawal form, he/she may submit any other explicit declaration of his/her decision to withdraw from the contract.
4.2 Withdrawal conditions and effect
Following the exercise of the withdrawal right, IdressItalian will refund all payments made by the purchaser, including delivery costs (except for any additional costs arising from the choice of a type of delivery other than the standard one offered by IdressItalian), without undue delay and in any event no later than 14 days from the day IdressItalian is informed by the customer of the decision to exercise the withdrawal right. Such refunds will be made using the same payment instrument used by the customer at the time of purchase, unless otherwise agreed.
The refund may be suspended until receipt by IdressItalian of the products or until the customer demonstrates that the products have been shipped, whichever is earlier. The customer must return or deliver the products without undue delay and in any event within 14 days from the day on which he/she communicated his/her intention to withdraw from the purchase agreement. The products must be returned-correctly packaged in their original packaging, not ruined, damaged or soiled) and equipped with all accessories, instructions for use and documentation, if any.
In case of loss of the original packaging, the Customer must, at his/her own care and cost, arrange for its replacement in order to be able to proceed with the return of the Products; - equipped with the transport document (present in the original packaging), so as to allow IdressItalian to identify the customer (Order number, name, surname and address); - without manifest signs of use, other than those compatible with carrying out a normal test of the product (they must not shall not show evidence of prolonged use or otherwise in excess of the time required for a trial and shall not be in a condition to prevent them from resale).
Products return costs will be borne by the client. The Customer is liable for any value decrease of the products as a result of any use of the products other than that necessary to establish the nature, characteristics and functioning of the products.
5. Refunds
Refunds will be credited directly to the account or payment instrument used at the time of purchase. For payments made by wire transfer, the refund will be made to the account used for payment. For payments made by Paypal or credit card, the refund will be made to the Paypal account or credit card.

7. Warranty for defects and deformities of products and additional information
7.1 Purchases made on the Website are subject to the rules of the Consumer Code on warranty for defects and deformities of products. The customer can exercise the rights under Article 130 of the Consumer Code and these rights must be exercised within the terms of Article 132 of the Consumer Code.
8. Applicable Law
8.1 These T&C and the contracts of sale are governed by Italian law (and in particular by the Consumer Code - which in articles 46 to 67 regulates distance contracts - and by Legislative Decree 70 of 09/04/2003 on electronic commerce) and must be interpreted in light of this.
8.2 For any disputes that may arise in connection with the T&C and/or contracts of purchase and sale, the customers may activate an out-of-court dispute resolution procedure that complies with the requirements of Articles 141 et seq. of the Consumer Code. In the event that the customer activates the above procedure IdressItalian guarantees its participation in an attempt at amicable settlement that the customer may promote before "Risolvi Online", an independent and institutional service provided by the Chamber of Arbitration of the Chamber of Commerce of Milan.
